Acceptance of Terms

These Terms of Service govern your use of Web Harmonium Pro, including the website, browser-based harmonium experience, account features, payments, and related services. By accessing or using Web Harmonium Pro, you agree to these Terms. If you do not agree, do not use the service.

Eligibility and Accounts

You are responsible for making sure your use of the service is lawful where you are located. If you create an account, you must provide accurate information, keep your credentials secure, and promptly notify us if you believe your account has been accessed without authorization.

You are responsible for activity that occurs through your account unless the activity results from our own failure to maintain reasonable security.

Use of the Service

You may use Web Harmonium Pro for personal, educational, evaluation, and other lawful purposes consistent with these Terms. We may update, improve, suspend, or discontinue parts of the service at any time.

You agree not to:

• use the service in violation of any law or regulation;
• interfere with the operation, security, or availability of the service;
• attempt unauthorized access to accounts, systems, or data;
• use bots, scraping, or automated abuse that harms the service or other users;
• upload, transmit, or share unlawful, infringing, malicious, or deceptive content through the service;
• misrepresent your identity, affiliation, or authorization to act for another person or entity.

Payments, Credits, and Paid Features

Some features may require payment, credits, or a paid plan. If you make a purchase, you agree to provide current and valid payment information through the checkout flow made available to you.

Prices, feature limits, included credits, billing intervals, and any product-specific terms shown at checkout or on the pricing page become part of your purchase. Unless required by law, fees already paid are non-refundable once the purchased service, credits, or subscription benefits have been provisioned.

We may change pricing or offerings prospectively. Changes do not affect charges already processed, but they may apply to future purchases or renewals after notice where required.

Intellectual Property and Open-Source Components

Web Harmonium Pro includes a mix of original site content, branding, configuration, and open-source components. Unless a separate license says otherwise:

• the Web Harmonium Pro name, branding, site copy, and site-specific presentation are owned by their respective rights holders;
• open-source components remain subject to their applicable licenses;
• third-party names, logos, and content remain the property of their respective owners.

These Terms do not transfer ownership of the service or underlying intellectual property to you. However, nothing in these Terms overrides rights granted by an applicable open-source license.

Third-Party Services

The service may rely on or link to third-party services such as payment processors, analytics providers, authentication providers, embedded content, or external links. We are not responsible for third-party products or services, and your use of them is subject to their own terms and policies.

Availability and Service Quality

We aim to keep Web Harmonium Pro available and reliable, but we do not guarantee uninterrupted access, perfect audio behavior across every browser or device, or error-free operation at all times. Browser audio, MIDI, and other capabilities may depend on your device, permissions, and browser support.

Termination

We may suspend or terminate your access if we reasonably believe you have violated these Terms, created risk for other users, exposed us to legal liability, or misused the service. You may stop using the service at any time.

Sections that by their nature should survive termination, including ownership, disclaimers, limitation of liability, indemnity, and dispute-related provisions, will survive termination.

Disclaimer of Warranties

To the maximum extent permitted by law, Web Harmonium Pro is provided on an "as is" and "as available" basis. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the service will be uninterrupted, secure, or error-free.

Limitation of Liability

To the maximum extent permitted by law, Web Harmonium Pro and its operators, affiliates, licensors, service providers, and partners will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, revenue, profits, goodwill, or business opportunities arising from or related to your use of the service.

To the extent liability cannot be excluded, our aggregate liability for claims arising out of or relating to the service will be limited to the amount you paid us for the specific paid feature giving rise to the claim during the 12 months before the event giving rise to liability, or USD $100 if no such payment was made, whichever is greater.

Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Web Harmonium Pro and its operators from claims, damages, liabilities, losses, and expenses, including reasonable legal fees, arising from your unlawful use of the service, your content, or your violation of these Terms.

Governing Law

These Terms are governed by the laws applicable in the jurisdiction of the operator's principal place of business, unless mandatory law in your jurisdiction requires otherwise. If a dispute cannot be resolved informally, it will be resolved in the courts or forums with lawful jurisdiction over the matter.

Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated version on this page and may provide additional notice when required. By continuing to use the service after updated Terms become effective, you agree to the revised Terms.
